1. Acceptance of Terms

By accessing or using the Bayeni Containers website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Definitions

• “Company,” “We,” “Us”: Bayeni Containers
• “Customer,” “You”: Any person or entity purchasing or renting containers from us
• “Container”: Any shipping container, storage unit, or modified structure sold or rented by us
• “Services”: All products, delivery, modification, and related services provided by us

3. Use of Website

You agree to use our website only for lawful purposes. You must not use our website in any way that causes damage to the website or impairs its availability. Unauthorized use may give rise to a claim for damages and/or be a criminal offense.

4. Product Information

We make every effort to ensure that product descriptions, images, and specifications are accurate. However, slight variations may occur, particularly with used containers. Colors may appear differently on different screens. We recommend inspecting containers in person where possible.

5. Pricing and Payment

All prices are quoted in South African Rand (ZAR) and include VAT at 15% unless otherwise stated. Prices are subject to change without notice. Payment terms are 50% deposit to confirm order, with the balance due before delivery unless alternative arrangements have been agreed in writing.

6. Orders and Acceptance

Placement of an order does not constitute acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or product information, or suspected fraud.

7. Delivery

Delivery dates are estimates and not guaranteed. We are not liable for delays caused by circumstances beyond our control, including but not limited to weather, road conditions, strikes, or vehicle breakdowns. The customer is responsible for ensuring adequate site access and preparation.

8. Risk and Title

Risk in the container passes to the customer upon delivery. Title remains with us until full payment has been received. For rental containers, title remains with us throughout the rental period.

9. Warranties

New containers are covered by a 12-month structural warranty against manufacturing defects. Used containers are sold with a 6-month wind/watertight guarantee. Modified containers carry a 12-month workmanship warranty on modifications. These warranties do not cover damage caused by misuse, overloading, or negligence.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from the purchase or use of our products or services shall not exceed the purchase price paid for the specific product or service giving rise to the claim. We are not liable for any indirect, consequential, or incidental damages.

11. Intellectual Property

All content on this website, including text, images, logos, and designs, is the property of Bayeni Containers and is protected by South African and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the South African courts.

13. Consumer Protection Act

Nothing in these terms limits your rights under the South African Consumer Protection Act No. 68 of 2008. Where there is any conflict between these terms and the CPA, the CPA shall prevail to the extent of the inconsistency.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website constitutes acceptance of the revised terms.
